Section 4.17Technology fee
Needs a look
Sloppy wording in a fee provision invites questions about how court fees are collected and spent. See the fix
Plain English: what this chapter covers
The Charter is Ashburn's founding document, kind of like the city's constitution. It was passed by the Georgia General Assembly in 2001. It sets up a council of a mayor and five councilmembers, a hired city manager who runs day-to-day operations, the municipal court, how elections and vacancies work, and the city's taxing, budgeting and borrowing powers. Anything the Charter doesn't cover is handled by city ordinance or state law.
Tire Clerk of the Municipal Court of the City of Ashburn shall be entitled to charge and collect a technology fee as a surcharge to each criminal and quasi criminal fine paid. The technology fee shall be set by resolution of the Mayor and City Council from time to time. Such fee shall be exclusively to provide for the following technological needs of the Court:
The purchase, lease, maintenance, and installation of computer hardware and software; the purchase, lease, maintenance, and installation of equipment and software used for imaging, scanning, facsimile, communications, projections, and printing. All funds collected pursuant to this provision shall be maintained in a segregated account by the Clerk of the Court separate from other funds of the City, and shall be expended only for authorized purposes upon order of the Judge of the Municipal Court upon consultation with the Clerk of Court, City Manager, Chief of Police and or the Director of Public Safety.
