James Burgess for Ashburn City Council

Section 6.14Franchises

Unchanged since the 2001 charter

Needs a look

Residents and providers may think the city controls cable franchising when the state largely does. See the fix

Plain English: what this chapter covers

The Charter is Ashburn's founding document, kind of like the city's constitution. It was passed by the Georgia General Assembly in 2001. It sets up a council of a mayor and five councilmembers, a hired city manager who runs day-to-day operations, the municipal court, how elections and vacancies work, and the city's taxing, budgeting and borrowing powers. Anything the Charter doesn't cover is handled by city ordinance or state law.

(a) The city council shall have the power to grant for the use of this city's streets and alleys for the purposes of railroads, street railways, telephone companies, electric companies, electric membership corporations, cable television, and other telecommunications companies, gas companies, transportation companies, and other similar organizations. The city council shall determine the duration, terms, whether the same shall be exclusive or nonexclusive, and the consideration for such franchises; provided, however, no franchise shall be granted for a period in excess of 35 years, and no franchise shall be granted unless the city receives just and adequate compensation therefor. The city council shall provide for the registration of all franchises with the city clerk in a registration book kept by the clerk. The city council may provide by for the registration within a reasonable time of all franchises previously granted.

(b) If no agreement is in effect, the city council has the authority to impose a tax on gross receipts for the use of this city's streets and alleys for the purposes of railroads, street railways, telephone companies, electric companies, electric membership corporations, cable television, and other telecommunications companies, gas companies, transportation companies, and other similar organizations.
