James Burgess for Ashburn City Council

Section 2.12Vacancy; filling of vacancies

Unchanged since the 2001 charter
Plain English: what this chapter covers

The Charter is Ashburn's founding document, kind of like the city's constitution. It was passed by the Georgia General Assembly in 2001. It sets up a council of a mayor and five councilmembers, a hired city manager who runs day-to-day operations, the municipal court, how elections and vacancies work, and the city's taxing, budgeting and borrowing powers. Anything the Charter doesn't cover is handled by city ordinance or state law.

(a) Vacancies. The office of mayor or councilmember shall become vacant upon the occurrence of any event specified by the Constitution of the State of Georgia, tit. 45, or such other applicable laws as are or may hereafter be enacted.

(b) Filling of vacancies. A vacancy in the office of mayor or councilmember shall be filled for the remainder of the unexpired terms, if any, by appointment by the remaining councilmembers if less than six months remain in the unexpired term, otherwise by an election, as provided for in Section 5.14 of this Charter and in accordance with tits. 21 and 22, or other such laws as are or may hereafter be enacted.

This is a plain-English guide, not legal advice. The official code is on Municode and at City Hall. Our copy is from April 30, 2026.
