Sec. 22-1Use of property
Needs a look
Vendors could be treated inconsistently, and the two-per-year cap limits downtown activity. See the fix
Plain English: what this chapter covers
This is the chapter for anyone running a business in town: the yearly occupation tax (the city's business license), plus special rules for pawn shops, phone companies, arcades and coin-operated machines, fireworks stands, food trucks, and permits for special events on city property like festivals, parades and big cookouts in the park. Several parts are fairly recent (2015-2025), but some, like the pawnshop rules, are older and still describe paper record books.
(a) It shall be unlawful for any owner of property in the downtown commercial district of the city to allow any person other than the property owner or the owner of the business establishment located on the property to offer goods or merchandise for sale in the outdoor areas of such property without obtaining a permit from the city for such activity.
(b) Any property owner or business owner within the downtown commercial district may obtain the requisite permit from the city by paying a permit fee of $5.00. No more than two such permits shall be granted to any property owner or business owner in any calendar year.
(c) The adoption of this section shall not confer any right to any property owner or business owner and any application for permit may be denied by the city if in the sole judgment of the city the display of the merchandise is an impediment to the free flow of traffic, is unsightly or offensive, or in any way threatens the health, safety, and welfare of the citizens of the city.
(d) This section shall not prohibit the sale of goods and merchandise during festivals and other public events that are approved and sanctioned by the city council by resolution.
