Sec. 2-34[Review and approval of minutes of executive sessions of the mayor and council.]

Last changed 2012
Plain English: what this chapter covers

Chapter 2 covers how city government runs: when the council meets and how residents can speak, the ethics code and how to file a complaint, rules for city employees (including drug testing and the city minimum wage), budgeting and purchasing limits, city credit cards, the Community Relations Commission, and how the city protects utility customers' personal information.

(a) The Open Meetings Act of the State of Georgia, § 50-14-1(e)(2)C, as amended, provides that:

(1) Minutes of executive sessions shall be recorded but shall not be open to the public; and

(2) Such minutes shall specify each issue discussed in executive session, and if matters subject to the attorney-client privilege are discussed, the fact that an attorney client discussion occurred and its subject matter shall [be] identified, but the substance of the discussion need not be recorded and shall not be identified in the minutes;

(3) Such minutes shall be kept and preserved for "in camera" inspection by an appropriate court should a dispute arise as to the propriety of any executive session.

(b) Minutes may be made and records kept by the city clerk or by a person temporarily appointed by the mayor to take such minutes so long as the minutes accurately reflect the record of the meeting.

(c) The mayor and council of the City of Ashburn designate the city clerk, or, at the option of the mayor, the mayor's designee, to record minutes of an executive session of the mayor and council.

(d) Prior to the conclusion of the executive session, the mayor, if he or she attends the session, and all members of the council attending the session shall review the minutes recorded.

(e) Following the conclusion of the executive session, and upon approval of such minutes by a majority of the mayor and council in an open meeting, the minutes of the executive session recorded and approved in accord with the terms hereof and as noted on the minutes shall be transmitted to the city clerk to be placed in proper form and kept in a confidential file and preserved for "in camera" inspection in accordance with § 50-14-1(e)(2)C.
