Needs a look
If no one is in the manager's chair, residents may have no clear place to file an ethics complaint. See the fix
Plain English: what this chapter covers
Chapter 2 covers how city government runs: when the council meets and how residents can speak, the ethics code and how to file a complaint, rules for city employees (including drug testing and the city minimum wage), budgeting and purchasing limits, city credit cards, the Community Relations Commission, and how the city protects utility customers' personal information.
Any person having a complaint against any member of the governing authority for an alleged ethics violation shall file in writing a verified complaint setting forth the particular facts and circumstances which constitute the alleged violation against the governing authority. The complaint shall be filed with the city manager unless the complaint regards the city manager in which case it shall be filed with the mayor. Upon receipt of a complaint, the city manager (or the mayor if the complaint regards the city manager) shall appoint three members of the city council, who, along with the city attorney, shall constitute an investigating committee to determine whether the complaint sets forth significant facts and circumstances so as to warrant a hearing before the board of ethics. In the event the complaint does not set forth sufficient facts to constitute an alleged violation and is found unjustified, frivolous, or patently unfounded, it shall be dismissed and the complainant notified immediately. In the event the complaint is found to state sufficient facts to warrant a hearing before the board of ethics, the board shall be appointed as provided herein.
