Sec. 46-32Findings of fact

Last changed 2009
Plain English: what this chapter covers

This chapter is Ashburn's flood damage prevention ordinance, the set of rules that keeps the city in the National Flood Insurance Program. It applies to FEMA-mapped flood hazard areas: you need a development permit before building or filling there, new homes have to be raised above expected flood levels, and floodways have to stay clear. It doesn't cover everyday ditch or yard flooding outside the mapped zones.

(a) The flood hazard areas of Ashburn, Georgia are subject to periodic inundation which results in loss of life and property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for flood relief and protection, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare.

(b) These flood losses are caused by the occupancy in flood hazard areas of uses vulnerable to floods, which are inadequately elevated, floodproofed, or otherwise unprotected from flood damages, and by the cumulative effect of obstructions in floodplains causing increases in flood heights and velocities.
