Without a stated penalty, building in a floodplain without a permit is hard to enforce, and residents can't tell what the consequences are. See the fix
Plain English: what this chapter covers
This chapter is Ashburn's flood damage prevention ordinance, the set of rules that keeps the city in the National Flood Insurance Program. It applies to FEMA-mapped flood hazard areas: you need a development permit before building or filling there, new homes have to be raised above expected flood levels, and floodways have to stay clear. It doesn't cover everyday ditch or yard flooding outside the mapped zones.
Failure to comply with the provisions of this article or with any of its requirements, including conditions and safeguards established in connection with grants of or shall constitute a violation. Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be fined not more than $(subject to court) or imprisoned for not more than (subject to court) days, or both, and in addition, shall pay all costs and expenses involved in the case. Each day such violation continues shall be considered a separate offense. Nothing herein contained shall prevent the City of Ashburn, Georgia from taking such other lawful actions as is necessary to prevent or remedy any violation.
