Sec. 54-96Requirement of conformance with certificate of appropriateness application
Plain English: what this chapter covers
This chapter creates the Ashburn Historic Preservation Commission (HPC) and the Ashburn Local Historic District. If your property is a designated historic property or sits in the district, you need a 'certificate of appropriateness' from the HPC before making exterior changes, demolishing or moving a building. Ordinary repairs, interior work and paint colors don't need one.
(a) All work performed pursuant to an approved certificate of appropriateness application shall conform to the requirements of such application. In the event work is performed not in accordance with such application, the HPC shall issue a cease and desist order and all work shall cease.
(b) Upon completion of the work performed pursuant to an approved certificate of appropriateness application, HPC staff shall inspect such work to ensure compliance with the approved application. Staff shall issue a fully-executed certificate of appropriateness to the applicant after it finds the work completed is in compliance.
(c) The mayor and city council or HPC shall be authorized to institute any appropriate action or proceeding in a court or competent jurisdiction to prevent any material change in appearance of a designated historic property or historic district. Except those changes made in compliance with the provision of this chapter or to prevent any illegal act or conduct with respect to such historic property or historic district.
