Sec. 54-123Affirmation of existing building and zoning codes and permits required
Plain English: what this chapter covers
This chapter creates the Ashburn Historic Preservation Commission (HPC) and the Ashburn Local Historic District. If your property is a designated historic property or sits in the district, you need a 'certificate of appropriateness' from the HPC before making exterior changes, demolishing or moving a building. Ordinary repairs, interior work and paint colors don't need one.
(a) Nothing in this chapter shall be construed as to exempt property owners from complying with existing city or county building and zoning codes, nor to prevent any property owner from making any use of his or her property not prohibited by other statutes, , or regulations.
(b) The approval of applications for certificate of appropriateness and the issuance of certificate of appropriateness shall not relieve the applicant from obtaining other permits and approvals required by the city. A building permit or other municipal permit shall be invalid if it is obtained without the presentation of the approved certificate of appropriateness application required for the proposed work. The HPC does not have any control over uses permitted within any designed historic property, and so the HPC does not approve proposed uses. The zoning administrator shall be the sole administrator of this Code as it pertains to the requirements for permitted or permissible uses.
