Sec. 62-210Abandoned shopping cart prevention and retrieval plans

Last changed 2018

Needs a look

A store with exactly 10 carts can't tell whether it's covered, and the city has no set process for returning carts it collects. See the fix

Plain English: what this chapter covers

This is the city's general 'don't do it' chapter. It covers firing guns, loitering, noise, fireworks, juvenile and park curfews, disorderly conduct, littering, false burglar alarms and abandoned shopping carts. Most violations go to Ashburn Municipal Court.

Each retail establishment with ten or more shopping carts is hereby required to develop and implement a specific plan to retrieve its shopping carts that are found throughout the city. Two or more retail establishments may collaborate and submit to the city a single plan. Plans for existing businesses within the city must be submitted to the city within 60 days of the effective date of this article, and must include an effective and specific method of retrieving the retail establishment's shopping carts found throughout the city. All new developments and businesses having more than ten carts shall be required to provide a cart retrieval plan prior to the issuance of a certificate of occupancy for their facility. The plan must include:

(1) Owner information. The name of the owner; the physical address where the retail establishment is conducted; and the name, address, and telephone number(s) of the owner and all on-site managers, including any changes of such persons.

(2) Shopping carts to be maintained on-site. A description of the manner shopping carts will be maintained on site and the measures that will be implemented to prevent cart removal from business premises. These measures may include, but are not limited to:

a. Installing disabling devices on all carts;

b. Installing bollards and chains around business entrances/exists to prevent cart removal;

c. Providing carts for rental or sale that can be temporarily or permanently used for the purpose of transporting purchases; or

d. Providing personnel for the purposes of the retrieval of lost, stolen or abandoned shopping carts. Such personnel may be either employees of the business or one or more independent contractors hired by the owner to provide shopping cart retrieval services, or combination of both.

(3) Employee training. The owner of the retail establishment shall implement and maintain a periodic training program for its new and existing store managers designed to educate such employees concerning the requirements of the plan and the provisions of state law prohibiting the unauthorized removal of shopping carts from the premises of the retail establishment.
