Sec. 34-11Holding defendant when court lacks jurisdiction

Elected officials making bail and jail decisions mixes politics with the court and conflicts with the city's own 2018 judicial independence language. See the fix
Plain English: what this chapter covers
This chapter lays out how Ashburn's municipal court runs: when it meets, how tickets and summonses get served, what happens if you miss court, and how bonds work. It also sets up the court-appointed defense lawyer and city prosecutor positions, and the extra charges added on top of fines. If you ever get a city citation, this is the chapter that explains the process.
If, after an investigation of any case, it should appear that the has no jurisdiction to determine it, the municipal court judge or the mayor shall require the defendant to enter into bond conditioned to appear before the next term of the court having jurisdiction, to answer such offense, which bond shall be turned over to the proper officer of such court. In default of such bond the municipal court judge or the mayor shall have power to commit the defendant to jail to answer the offense at the next term of court having jurisdiction thereof.
