James Burgess for Ashburn City Council

Sec. 34-12Rules of practice

Unchanged since the 2007 code
Plain English: what this chapter covers

This chapter lays out how Ashburn's municipal court runs: when it meets, how tickets and summonses get served, what happens if you miss court, and how bonds work. It also sets up the court-appointed defense lawyer and city prosecutor positions, and the extra charges added on top of fines. If you ever get a city citation, this is the chapter that explains the process.

The city shall have the opening and conclusion in each case unless the defendant introduces no evidence. The defendant shall then be entitled to the conclusion. The city shall announce first if it is ready for trial; and, if not, it shall be held to as strict a showing for continuances as the defendant. The rules of evidence and examination of witnesses shall be the same as in the superior court, so far as such rules are applicable to the case on trial. All officers, informers, and persons injured shall be competent witnesses. In general, the shall be controlled by the rules of practice governing the superior court, so far as they are applicable to municipal courts, and by a sound construction of the Charter and of the city.

This is a plain-English guide, not legal advice. The official code is on Municode and at City Hall. Our copy is from April 30, 2026.
