Sec. 82-2Regulating commercial truck traffic in residential subdivisions
Needs a look
Truck drivers and residents can't easily tell which streets are covered, which makes the rule hard to enforce fairly. See the fix
Plain English: what this chapter covers
This chapter covers the everyday rules of the road in Ashburn. It adopts Georgia's Uniform Rules of the Road, sets speed zones, keeps big commercial trucks off residential streets except to make deliveries, and controls junk cars stored outside. It also lets residents drive golf carts ("motorized carts") on most city streets, and it sets up school-zone speed cameras along with how those tickets and appeals work.
(a) Definition of commercial trucks. The following classes of vehicles are hereby declared to be commercial trucks:
Pole trailer means every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach or pole, or by being boomed or otherwise secured to the towing vehicle and ordinarily used for transporting long or irregular shaped loads, such as poles, pipes, or structural members capable, generally, of sustaining themselves as beams between the supporting connections.
Semi-trailer means every vehicle with or without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
Tractor means any self-propelled vehicle designed for use as a traveling power plant or for drawing other vehicles but having no provision for carrying loads independent.
Truck means every motor vehicle designed, used, or maintained primarily for the transportation of property; except, that class of vehicles known as pickup trucks shall not constitute commercial trucks unless they are towing a pole trailer or a semi-trailer.
Truck tractor means every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the vehicle and load so drawn.
Dump trucks, earth movers, crane trucks, and other heavy equipment when such vehicle or equipment is not necessary for the construction, renovation, or maintenance of the road or structures within the subdivision.
(b) Operation prohibited. The operation or parking of a commercial truck or other vehicle, as defined in paragraph (a), upon the residential streets of the city is hereby prohibited; provided, however, commercial trucks, while being used in making deliveries or taking on cargo for transportation from within a residential subdivision, shall not be prohibited.
(c) Truck routes. Those portions of Highway 112/32, Highway 41, Highway 159, Industrial Drive, Silvia Drive and One Georgia Drive within the corporate limits of the city are designated as truck routes. The operation of commercial trucks shall be permitted on designated truck routes.
(d) Violation of section. Any person convicted of a violation of any provision of this section shall be punished by a fine of not more than $1,000.00 and/or imprisonment for not more than 180 days. Each incident shall be construed to be a separate violation.
