Sec. 82-3Motorized carts

Golf cart owners can't tell for sure which streets and crossings are legal, and newer four-wheel carts may not fit the city's definition. See the fix

Plain English: what this chapter covers

This chapter covers the everyday rules of the road in Ashburn. It adopts Georgia's Uniform Rules of the Road, sets speed zones, keeps big commercial trucks off residential streets except to make deliveries, and controls junk cars stored outside. It also lets residents drive golf carts ("motorized carts") on most city streets, and it sets up school-zone speed cameras along with how those tickets and appeals work.

(a) For the purposes of this section, "motorized carts" shall mean every vehicle having no fewer that three wheels and an unladen weight of 1,300 lbs. or less which cannot operate at more than 20 miles per hour.

(b) Motorized carts may be operated on city streets where the posted speed limit is 35 miles per hour or less.

(c) Motorized carts may be operated on all city streets other than state highways, even in areas where the posted speed limit is 35 miles per hour or less, except that these highways may be crossed in designated areas specified below.

(d) Motorized carts may cross state highways which are under the jurisdiction of the Department of Transportation only at designated areas and may not cross State Highway 41, 112 and 59, even where these highways come through town, until such a time as the Department of Transportation designates such crossing areas.

(e) Motorized carts may be operated on city streets only during daylight hours unless they comply with the equipment regulations promulgated by the Commissioner of Public Safety.

(f) Motorized carts shall not be required to meet any requirements of general law as to registration, inspection, or licensing. Provided however, no motorized cart shall operate on the streets of the city without first registering with the city and paying a license fee of $15.00 which shall remain permanently with such cart unless such cart is sold or the license is destroyed.

(g) Operators of motorized carts on city streets must have a valid driver's license or learner's permit and shall be subject to the Uniform Rules of the Road and all other state and local traffic regulations applicable to a driver of any other motorized vehicle.

(h) No person 15 years or younger shall either operate or be a passenger in a motorized cart without wearing a seatbelt.

(i) Any motorized cart operating on the streets of Ashburn shall carry bodily injury and property damage liability insurance in the amount of $25,000.00.
