Sec. 43-63Burn requirements and conditions

Needs a look

Residents get mixed messages from state and city rules about whether they can burn leaves in their own yard. See the fix

A misnumbered section is hard to find and cite, both for residents and in citations. See the fix

Plain English: what this chapter covers

This short chapter sets up the fire department and spells out Ashburn's burning rules. You need a free permit from Ashburn Fire and Emergency Services to burn natural vegetation, the burn has to be well away from houses and streets, and you can never burn trash, tires, plastics or building materials.

(a) The location of the burn must be a minimum of 500 feet from structures or public streets unless otherwise varied/allowed by the city fire chief.

(b) Only natural vegetation (trees, bush, stumps, grass, shrubs, etc.) that contains small amounts of soil shall be burned.

(c) Open land burning if permitted will require a plowed fire break, and the burn permit recipient must take the necessary measures to ensure that the fire does not spread onto the property of others.

(d) Permitted burning must not be left unattended at any time.

(e) Burn permits may only be issued to property owner or tenant. However, tenants must have written permission from the property's owner before a permit will be issued.

(f) Burn permits will not be issued to demolish a standing structure.

(g) Pit and blower may be required for large scale burning.

(h) Contractors will be required to be adequately licensed and bonded, and provide a certificate of insurance in the amount of $100,000.00 or more prior to being issued a burn permit.

(i) Property owners and/or tenants must have adequate insurance to cover damage to the property of others in case of fire spread.

(j) Tires or other rubber products, plastics, paper goods, petroleum products, or asphalt based or impregnated materials may not be used to start or maintain the operation of the burn.

(k) Construction materials or manmade materials can not be burned.

(l) Prevailing winds must be in a direction away from any residential areas near the proposed burn area.

(m) Humidity must be such that residual smoke will not settle to surrounding ground areas.

(n) Burning will not commence prior to one hour after sunrise local time and must be extinguished by one hour prior to sundown local time.

(o) Burn permits will not be issued during times of drought or "statewide no burn" advisories from the Georgia Forestry Commission.

(p) Ashburn Fire and Emergency Services will have the authority to stop the burn at any time should any of the above conditions not be met.
