Sec. 54-88Denial
Plain English: what this chapter covers
This chapter creates the Ashburn Historic Preservation Commission (HPC) and the Ashburn Local Historic District. If your property is a designated historic property or sits in the district, you need a 'certificate of appropriateness' from the HPC before making exterior changes, demolishing or moving a building. Ordinary repairs, interior work and paint colors don't need one.
Denial of an application by the HPC shall preclude consideration of a substantially similar request for a period of 12 months from the date of the meeting at which the denial was given. This period of preclusion does not apply if a substantially different request is submitted which addresses the grounds for denial. The HPC shall determine if a request is "substantially different" and addresses the grounds for denial, allowing for reconsideration within the 12-month period.
