Sec. 54-89HPC decision on application for certificate of appropriateness
Plain English: what this chapter covers
This chapter creates the Ashburn Historic Preservation Commission (HPC) and the Ashburn Local Historic District. If your property is a designated historic property or sits in the district, you need a 'certificate of appropriateness' from the HPC before making exterior changes, demolishing or moving a building. Ordinary repairs, interior work and paint colors don't need one.
(a) The HPC shall approve the application if it finds that the proposed material change(s) would not have a substantial adverse effect on the aesthetic, historic, or architectural significance and value of the historic property of the historic district.
(b) The HPC shall approve with conditions the application upon finding that the proposed material change(s) would not have a substantial adverse effect on the aesthetic, historic, or architectural significance and value of the historic property of the historic district if the applicant fulfills certain condition(s) mandated by the HPC.
(c) The HPC shall deny the application if it finds that the proposed material change(s) in appearance would have substantial adverse effects on the aesthetic, historic, or architectural significance and value of the historic property or the historic district.
