Sec. 54-90Public hearings on applications for certificate of appropriateness, notices, and right to be heard
Plain English: what this chapter covers
This chapter creates the Ashburn Historic Preservation Commission (HPC) and the Ashburn Local Historic District. If your property is a designated historic property or sits in the district, you need a 'certificate of appropriateness' from the HPC before making exterior changes, demolishing or moving a building. Ordinary repairs, interior work and paint colors don't need one.
At least seven days prior to review of a certificate of appropriateness, the HPC shall take such action as may reasonably be required to inform the owners of any property likely to be affected by reason of the application, and shall give applicant and such owners an opportunity to be heard. In cases where the HPC deems it necessary, it may hold a public hearing concerning the application; provided that, as required by subsection 54-85(b), in all applications involving the demolition of a structure, a public hearing shall be held. In the event a public hearing is required pursuant to subsection 54-85(b) or in the event the HPC elects to hold a public hearing as provided in this section, notice of said public hearing shall be provided in accordance with the following.
At least a ten-day notice of the time and place of each public hearing shall be given by the HPC as follows:
(a) In writing to the applicant and the abutting property owners;
(b) By publication at least once in the form of an advertisement in a newspaper of general circulation within the city; and
(c) By sign posted on the property.
